These Terms of Service govern your access to and use of Dealino, a buying-signal research and lead context service operated by Morelli Holding GmbH, Stockhornstraße 50, 68169 Mannheim, Germany ("Dealino", "we", "us", or "our"). By placing an order or using the service, you agree to these terms.
2. The Service
Dealino researches recent public buying signals based on the targeting criteria you provide. A delivered lead may include source context, company information, fit notes, suggested reply guidance, and a link or reference to the original public source where available.
Dealino is a research and information service. We do not provide legal, financial, tax, employment, or investment advice.
3. Orders and Customer Responsibilities
You are responsible for:
- Providing accurate targeting criteria, exclusions, and market information.
- Reviewing delivered leads before outreach or other use.
- Complying with all laws, regulations, platform terms, and outreach rules that apply to your use of the leads.
- Ensuring that your products, services, and outreach claims are truthful and lawful.
4. Acceptable Use
You must not use Dealino or delivered lead information to:
- Send unlawful spam or unsolicited communications.
- Harass, discriminate against, deceive, or harm any person or organization.
- Violate privacy, data protection, marketing, platform, or intellectual property rules.
- Resell, scrape, or bulk redistribute delivered research unless we agree in writing.
- Attempt to reverse engineer, interfere with, or misuse the website or service.
5. Public Sources and Third-Party Platforms
Leads may be based on public information from third-party platforms, websites, social networks, forums, directories, or other sources. Third-party content may change, be removed, or become unavailable after delivery. We do not control or endorse third-party platforms and are not responsible for their availability, terms, or content.
6. Fees, Taxes, and Payment
Fees are shown at checkout and are payable in advance unless otherwise agreed. You are responsible for applicable taxes, duties, and bank or payment provider fees. Payments are processed by Stripe and may be subject to that provider's terms.
7. Delivery, Replacements, and Refunds
Delivery timing, replacement criteria, and refund conditions are described in our Refund Policy. We may replace a lead that clearly misses the targeting criteria submitted before research began.
8. No Guarantee of Results
We aim to provide relevant lead opportunities, but we do not guarantee that any lead will reply, book a meeting, become a customer, generate revenue, or produce any specific result.
9. Intellectual Property
We own the Dealino website, brand, copy, design, templates, processes, and other service materials. Subject to your payment and compliance with these terms, you may use delivered lead research internally for your business outreach and sales operations.
10. Privacy
Our Privacy Policy explains how we collect and use personal data. By using Dealino, you acknowledge that we process personal data as described there.
11. Confidentiality
If you share non-public business information with us for targeting or support, we will use it only to provide and improve the service, support your order, and comply with law. This obligation does not apply to information that is public, independently developed, already known to us, or lawfully received from another source.
12. Disclaimer
To the fullest extent permitted by law, Dealino is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim related to the service is limited to the amount you paid for the order giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost goodwill, or lost data.
14. Indemnity
You agree to defend and indemnify us from claims, damages, losses, liabilities, costs, and expenses arising from your unlawful use of the service, your outreach, your breach of these terms, or your violation of third-party rights.
15. Refusal or Suspension
We may refuse, pause, or stop providing the service if we reasonably believe an order, customer, market, product, or intended use is unlawful, harmful, abusive, or inconsistent with these terms.
16. Changes
We may update these terms from time to time. The updated terms will be posted on this page with a revised effective date. Continued use of the service after an update means you accept the updated terms.
